When a sewer line fails, the first question is almost always: 'Is this the town's problem or mine?' In most of New Jersey, the answer surprises people.
The sewer lateral is the pipe that connects your home to the municipal main, which typically runs under the street. In most NJ municipalities, the property owner is responsible for the entire lateral — and in many towns, that includes the portion that runs under the street and up to the connection at the main.
The municipality generally maintains the public main itself. If a backup is caused by a problem in the city main, that's on them. If it's in your lateral — which is where the vast majority of residential sewer problems occur — it's your responsibility.
Because homeowners own the lateral, a sewer failure isn't covered by the town, and standard homeowners insurance often excludes it too. That's why catching problems early with a camera inspection is so valuable.
